การแบ่งเขตไหล่ทวีปภายใต้กฎหมายทะเลระหว่างประเทศ: ศึกษาจากแนวคำวินิจฉัยของศาลยุติธรรมระหว่างประเทศและศาลกฎหมายทะเลระหว่างประเทศ

บทคัดย่อ
ในปัจจุบัน ปัญหาข้อพิพาทระหว่างเขตแดนเป็นสิ่งที่รัฐต่าง ๆ ยังคงให้ความสำคัญ โดยเฉพาะเขตแดนทางทะเล เนื่องจากพื้นที่ทางทะเลเป็นดินแดนที่อุดมไปด้วยทรัพยากรมีชีวิตและทรัพยากรที่ไม่มีชีวิตอย่างมหาศาล สิ่งเหล่านี้ทำให้รัฐชายฝั่งมุ่งหมายที่จะแสวงหาผลประโยชน์และใช้ประโยชน์จากทรัพยากรเหล่านั้นเพื่อพัฒนาเศษฐกิจและสร้างความมั่งคั่งให้แก่รัฐ เพื่อให้ได้มาซึ่งผลประโยชน์ดังกล่าวการอ้างสิทธิทับซ้อนกันในพื้นที่ทางทะเลย่อมเกิดขึ้นและนำไปสู่ข้อพิพาทในการอ้างสิทธิตามกฎหมายระหว่างประเทศในเวลาต่อมาด้วยเหตุนี้ เพื่อเป็นประโยชน์ต่อการศึกษากระบวนการและวิธีการกำหนดเขตแดนทางทะเล บทความชิ้นนี้จึงขอนำเสนอขั้นตอนการกำหนดเขตแดน โดยมุ่งเน้นที่แนวทางการกำหนดเขตไหล่ทวีปซึ่งบทความชิ้นนี้จะนำเสนอและอธิบายหลักการกำหนดเขตไหล่ทวีปซึ่งปรากฏในอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล และพิจารณาแนวทางคำพิพากษาของศาลยุติธรรมระหว่างประเทศและศาลกฎหมายทะเลระหว่างประเทศ
